Placing and fulfilling orders

Information about the Goods presented in the Shop, in particular their descriptions, photos, prices and availability, constitutes an invitation to conclude a contract within the meaning of the applicable law, and not an offer within the meaning of the Polish Civil Code.

Orders can be placed 24 hours a day, 7 days a week, via the Shop.

To place an order, the Buyer: 1) selects the Goods and adds them to the cart, 2) goes to the order form, 3) provides the data needed to fulfil the order, 4) chooses the delivery method, 5) chooses the payment method, 6) reads and accepts the Terms and Conditions, 7) confirms the order with an obligation to pay.

Before placing an order, the Buyer is informed of the main characteristics of the Goods, the total price including taxes, the delivery costs and any other costs, if applicable.

An order is placed once the Buyer has completed the steps indicated in the order form and confirmed the order with an obligation to pay.

By placing an order, the Buyer makes an offer to conclude a sales contract. The Seller confirms acceptance of the order for fulfilment by an e-mail sent to the address given in the order, automatically after the order is placed (for online payments - after the payment has been credited). The sales contract is concluded when this e-mail is sent. If the Buyer has not received a confirmation, they should check their SPAM folder or contact the Seller.

If, for reasons beyond the Seller's control, the order cannot be fulfilled, the Seller will promptly inform the Buyer and refund all payments made for the unfulfilled order.

For each order the Seller issues a VAT invoice on the day the order is shipped and sends it electronically to the e-mail address given in the order. By accepting the Terms and Conditions, the Buyer agrees to receive invoices electronically. Invoices for Buyers who provided a tax ID (NIP) in the order are issued in accordance with the regulations on the Polish National e-Invoicing System (KSeF).

The Buyer should provide the data needed to fulfil the order correctly. The Seller is not liable for delays caused by the Buyer providing incorrect or incomplete data, if this prevented the order from being fulfilled correctly.

§3. Prices and payments

All prices of the Goods presented in the Shop are gross prices, i.e. they include VAT at the applicable rate, and are given in Polish zloty (PLN).

The price of the Goods binding on the Buyer is the price shown in the Shop at the time the order is placed.

The delivery cost is shown to the Buyer before the order is placed and depends on the chosen delivery method and, where applicable, the parameters of the parcel.

The available payment methods are: 1) online payment via Przelewy24, 2) cash on delivery.

The online payment operator is PayPro S.A. with its registered office in Poznań, ul. Pastelowa 8, 60-198 Poznań, Poland, entered in the register of entrepreneurs of the National Court Register under KRS number 0000347935, NIP 7792369887, REGON 301345068.

For online payments, fulfilment of the order begins once the Seller has received confirmation that the payment was made correctly.

For cash on delivery, fulfilment of the order may begin once the order has been accepted for fulfilment.

If cash on delivery is chosen, a cash-on-delivery fee is added to the order in the amount shown in the order form before the order is placed.

§4. Delivery

Orders are delivered within Poland, subject to the availability of other delivery destinations indicated in the Shop.

The standard order processing time is 2-3 working days, counted: 1) from when the payment is credited - for prepaid orders, 2) from when the order is placed - for cash on delivery.

The order processing time means the time the Seller needs to prepare the order for shipping. The carrier's transit time may be additional.

The available delivery methods are: 1) delivery to an InPost parcel locker, 2) courier delivery.

The delivery cost is shown to the Buyer before the order is placed.

Delivery to an InPost parcel locker is free for orders worth at least the threshold shown on the product page and in the cart at the time the order is placed.

For products or parcels subject to special delivery rules because of their weight, size or nature, information on costs and available delivery methods is shown to the Buyer before the order is placed.

If the parcel cannot be delivered for reasons attributable to the Buyer, in particular because an incorrect address was given or the parcel was not collected, the Seller may contact the Buyer to agree how to proceed with the order.

§5. Right to withdraw from the contract

A Consumer, and the person referred to in §1(7), who has concluded a distance contract with the Seller may withdraw from it within 14 days without giving any reason, subject to the exceptions set out in paragraph 14.

The withdrawal period expires 14 days from the day on which the Buyer, or a third party other than the carrier indicated by the Buyer, took possession of the Goods. For a contract covering multiple Goods delivered separately, in batches or in parts, the period runs from the day of taking possession of the last item, batch or part.

To exercise the right of withdrawal, the Buyer should, before the period expires, submit to the Seller an unequivocal statement of withdrawal from the contract, e.g.: 1) by e-mail to: zamowienia@profibra.pl, 2) in writing to the Seller's address.

The Buyer may use the withdrawal form attached to these Terms and Conditions, but this is not mandatory. The statement may be submitted in any unequivocal form.

To meet the deadline, it is enough to send the statement of withdrawal before the period expires.

If the withdrawal is effective, the Seller refunds to the Buyer all payments received from them, including the cost of delivering the Goods to the Buyer, except for additional costs resulting from the Buyer choosing a delivery method other than the cheapest standard delivery method available in the Shop.

Payments are refunded using the same payment method the Buyer used, unless the Buyer has expressly agreed to a different solution.

The Seller refunds payments promptly, no later than 14 days from the day the statement of withdrawal is received.

The Seller may withhold the refund until it receives the returned Goods or until the Buyer provides proof of sending them back, whichever happens first.

The Buyer should send the Goods back promptly, no later than 14 days from the day on which they withdrew from the contract. To meet the deadline, it is enough to send the Goods back before the period expires.

The Goods should be sent back to: Profibra sp. z o.o., ul. Mycielskiego 6a, 31-999 Kraków, Poland.

The direct cost of returning the Goods is borne by the Buyer, unless the Seller has agreed to bear it or informed the Buyer before the contract was concluded that the Seller bears this cost.

The Buyer is liable for any diminished value of the Goods resulting from handling them beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

The right of withdrawal does not apply to contracts: 1) for the supply of Goods that deteriorate quickly or have a short shelf life; 2) for the supply of Goods delivered in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging was opened after delivery - this applies in particular to the food products offered in the Shop (mixes, concentrates and sourdough starters); 3) for the supply of Goods which, after delivery, are by their nature inseparably mixed with other items; 4) in the other cases listed in Article 38 of the Polish Consumer Rights Act, insofar as the situation applies to the Goods or service offered by the Seller.

Please note that for the Goods referred to in paragraph 14 point 2, opening the packaging after delivery results in the loss of the right to withdraw from the contract. To keep this right, the Buyer should check the Goods without breaking the sealed packaging (e.g. the outer condition of the packaging, the label, ingredients, best-before date). For Goods not covered by the exception, the Buyer may be liable for any diminished value of the Goods if they handled them beyond what is necessary to establish their nature, characteristics and functioning.

§6. Complaints - lack of conformity of the Goods with the contract

The Seller is liable to the Consumer for any lack of conformity of the Goods with the contract under the rules set out in the Polish Consumer Rights Act of 30 May 2014.

The Seller's liability for lack of conformity of the Goods with the contract covers the Goods in accordance with applicable law.

If the Goods are not in conformity with the contract, the Consumer may demand: 1) their repair, 2) their replacement.

In the cases provided for by law, the Consumer may demand: 1) a price reduction, 2) withdrawal from the contract.

In particular, the Consumer may demand a price reduction or withdraw from the contract if the conditions set out in the Act are met, in particular when: 1) the Seller has refused to bring the Goods into conformity with the contract, 2) the Seller has not brought the Goods into conformity with the contract within a reasonable time, 3) the Seller's actions have not brought the Goods into conformity with the contract, 4) the lack of conformity is so significant that it justifies a price reduction or withdrawal from the contract.

Complaints can be submitted: 1) by e-mail to zamowienia@profibra.pl, 2) in writing to the Seller's address.

A complaint should preferably include: 1) the Buyer's details, 2) details of the order or the Goods, 3) a description of the lack of conformity found, 4) the date it was found, 5) the Buyer's demand.

A receipt is not required to submit a complaint if the Buyer can otherwise prove that the Goods were bought from the Seller.

The Seller handles a Consumer's complaint within 14 days of receiving it. If the Seller does not respond within this period, the complaint is deemed accepted to the extent provided for by law.

If the complaint is accepted and the Goods need to be repaired or replaced, the costs of bringing the Goods into conformity with the contract are borne by the Seller, in accordance with applicable law.

If the Consumer withdraws from the contract because of a lack of conformity of the Goods with the contract, the costs of returning the Goods are borne by the Seller in accordance with the law.

This section does not limit or exclude the Consumer's rights under mandatory provisions of law.

§7. Guarantee

The Goods may be covered by a guarantee from the manufacturer or another guarantor, if such a guarantee has been granted.

Information about the guarantee, if one is granted, can be found in the documentation for the given Goods or is provided to the Buyer together with the Goods.

A guarantee does not exclude, limit or suspend the Consumer's rights under the Seller's statutory liability for lack of conformity of the Goods with the contract.

§8. Personal data

The rules for processing Buyers' personal data are set out in a separate Privacy Policy available in the Shop.

Personal data is processed in accordance with applicable law, in particular the regulations on personal data protection.

The Privacy Policy is available at: https://profibra.pl/en/polityka-prywatnosci/

§9. Out-of-court complaint handling and redress

The Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular the help of the competent municipal or district consumer ombudsman or a consumer organisation.

The Consumer may also use out-of-court consumer dispute resolution procedures conducted by authorised entities entered in the relevant register.

Up-to-date information on the available methods of out-of-court consumer dispute resolution is available from the Polish Office of Competition and Consumer Protection (UOKiK).

The Seller does not use the ODR platform, which no longer exists. The European Union's ODR platform was closed in 2025.

§10. Provisions concerning entrepreneurs

The provisions of these Terms and Conditions concerning Consumers also apply to natural persons running a business to the extent that the law grants them the protection provided for Consumers.

For Buyers who are neither Consumers nor persons referred to in §1(7), the Seller's liability and the scope of their rights are governed by law, taking into account the provisions of these Terms and Conditions.

§11. Changes to the Terms and Conditions

The Seller may change the Terms and Conditions for important reasons, in particular: 1) changes in the law, 2) changes in payment or delivery methods, 3) changes in the Seller's details, 4) changes in the Shop's functionality, 5) the need to remove provisions that do not comply with the law.

A change to the Terms and Conditions does not affect the rights acquired by Buyers under contracts concluded before the amended Terms and Conditions came into force.

Orders placed before the amended Terms and Conditions came into force are governed by the Terms and Conditions in force at the time the order was placed.

§12. Final provisions

Matters not regulated in these Terms and Conditions are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.

No provision of these Terms and Conditions is intended to exclude or limit the Consumer's rights under mandatory provisions of law.

If any provision of these Terms and Conditions proves invalid or ineffective, the remaining provisions remain in force, and the invalid provision is replaced by the relevant provision of law.

Disputes with Consumers are settled by the competent courts in accordance with applicable law.

These Terms and Conditions come into force on the date stated in them.

Appendix No. 1 - model withdrawal form

Addressee: Profibra sp. z o.o., ul.
